These Terms of Service ("Terms") are an agreement between you and TrakForge LLC
("TrakForge," "we," "us"), the maker of MacTrak. By creating an account or using
MacTrak, you agree to these Terms. If you do not agree, do not use MacTrak.
1. Eligibility
You must be at least 13 years old to use MacTrak. By using MacTrak, you represent
that you meet this requirement and have the capacity to enter into these Terms.
2. Your account
You agree to provide accurate information, keep your credentials secure, and
accept responsibility for activity under your account.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to
use MacTrak for your personal, non-commercial use, subject to these Terms and the
terms of the app store from which you downloaded it.
4. Subscriptions and billing
Certain features (including AI photo analysis) require a paid subscription.
Billing is handled by the Apple App Store or Google Play. Subscriptions renew
automatically until cancelled; you can cancel at any time in your app store account
settings, effective at the end of the current billing period. Refunds are governed
by the applicable app store's policies. Prices may change with notice as permitted
by app store rules. We never receive or store your payment card information.
Fair use of "unlimited" AI analysis: paid AI photo analysis is
offered on an unlimited basis subject to fair use. To protect service quality and
prevent abuse, AI analysis is rate-limited (currently up to 10 scans per hour) and
subject to automated abuse detection. These measures are not a usage cap and do not
affect normal personal use; we may adjust them as reasonably necessary to keep the
service reliable and secure for everyone.
5. Health disclaimer
MacTrak is a general wellness product provided for informational purposes only. It
is not medical advice and is not intended to diagnose, treat, cure, or prevent any
disease or condition. Calorie and nutrient values — including estimates produced by
AI photo analysis — are approximations. Consult a qualified healthcare professional
before changing your diet or exercise, particularly if you have a medical condition,
are pregnant, or have a history of disordered eating. MacTrak applies minimum
calorie floors by design and is not a substitute for professional care.
6. Your content
You retain ownership of the content you submit to MacTrak, such as custom foods,
recipes, and meal photos. You grant TrakForge a worldwide, non-exclusive,
royalty-free, sublicensable license to host, store, reproduce, process, and display
that content solely to operate, provide, secure, and support the service for you —
including transmitting meal photos to our AI provider for analysis as described in
the Privacy Policy. This license ends when you delete the content or your account,
except for copies already processed or retained as required by law. We do not use
your content to train AI models or for advertising. You represent that you have the
rights to the content you submit.
7. Food data sources
Nutrition data in MacTrak comes from USDA FoodData Central (a U.S. government
public-domain source) and from Open Food Facts, which is made available by Open
Food Facts contributors under the Open Database License (ODbL), as well as from
entries created by users. All data is provided "as is," and we do not guarantee its
accuracy or completeness.
8. Acceptable use
You agree not to: misuse, disrupt, or interfere with the service; access it by
automated means or scrape it; circumvent subscription or security controls; reverse
engineer the app except to the extent permitted by applicable law; or use MacTrak
for any unlawful purpose.
9. Intellectual property
MacTrak, its design, and the MacTrak and TrakForge names and logos are owned by
TrakForge LLC. Except for the license in Section 3, no rights are granted to
you.
10. Termination
You may stop using MacTrak, and may delete your account in the app, at any time.
We may suspend or terminate your access for violation of these Terms. Sections that
by their nature should survive termination (including Sections 5 through 9 and 11
through 14) survive.
11. Disclaimers
MacTrak is provided "as is" and "as available." To the fullest extent permitted by
law, we disclaim all warranties, express or implied, including merchantability,
fitness for a particular purpose, and non-infringement. Some jurisdictions do not
allow certain disclaimers, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, TrakForge will not be liable for indirect,
incidental, special, consequential, or punitive damages, and our aggregate liability
arising out of or relating to MacTrak will not exceed the greater of the amounts you
paid for MacTrak in the twelve (12) months before the claim arose or fifty U.S.
dollars (US$50). Nothing in these Terms limits liability that cannot be limited or
excluded under applicable law, including liability for gross negligence, willful
misconduct, fraud, or death or personal injury caused by our negligence. Some
jurisdictions do not allow certain limitations, so parts of this section may not
apply to you.
13. Indemnification
You agree to indemnify TrakForge against claims arising from your violation of
these Terms or your misuse of MacTrak, to the extent permitted by applicable
law.
14. Governing law; disputes
These Terms are governed by the laws of the State of Michigan, without regard to
conflict-of-laws principles. Any dispute shall be brought exclusively in the state
or federal courts located in Michigan, and the parties consent to their
jurisdiction.
15. App store terms
Your use of MacTrak is also subject to the applicable app store's terms. Apple and
Google are not parties to these Terms and have no obligation to provide support for
MacTrak; to the extent required by their agreements, they are third-party
beneficiaries of these Terms and may enforce them.
16. Changes to these Terms
We may update these Terms. If changes are material, we will provide notice in the
app or by email. Continued use after changes take effect constitutes acceptance.
17. General
These Terms are the entire agreement between you and TrakForge regarding MacTrak.
If any provision is held unenforceable, the remainder remains in effect. Our failure
to enforce a provision is not a waiver. We may assign these Terms; you may not.
